1. Who we are

Atlas Fitness & Health Center (“Atlas Fitness,” “Atlas,” “we,” “us,” or “our”) is a fitness facility located at 634 Migeon Ave, Torrington, CT 06790.

Atlas Fitness is committed to respecting the privacy and security of information provided by our members, clients, guests, prospective members, employees, trainers, website visitors, and users of our applications and digital services.

This Privacy Policy explains the types of information Atlas Fitness may collect, how we use and protect that information, how information may be processed through third-party service providers and technology platforms, including Club Automation and Google services, how long we keep it, how you can ask us to delete it, and the rights and choices available to you under applicable law.

2. What this policy covers

This Privacy Policy applies to information collected through or in connection with:

• Our physical facility in Torrington, Connecticut
• Membership, personal training, group class, and other fitness services
• Our website, atlasfitnessandhealthcenter.com
• Our mobile appfor Apple iOS and Google Android (“the App”), provided for Atlas Fitness by our membership-software provider, Club Automation
• Our online member portal, online forms, and digital services
• Our facility access-control system
• Email, phone, text message, push notification, and in-app communications
• Other services operated or provided by Atlas Fitness

If you use a service run by another company (for example, a payment processor's checkout page), that company's own privacy policy also applies to the information you give it.

3. Information we collect

Depending on the services you use and your relationship with Atlas Fitness, we may collect the following categories of information. We collect it directly from you (when you join, fill out a form, talk to staff, or use the App), automatically (when you badge in, use the App, or visit our website), and from our service providers (for example, payment status from a payment processor).

• Membership benefits or promotions
• Access credentials, such as a key fob, access card, App barcode, or similar credential

C. Payment and transaction information

• Membership, personal training, group class, and retail payments
• Payment dates, transaction amounts, refunds, credits, account balances, and payment status
• Payment method information

Payment card information may be processed by third-party payment processors. Atlas Fitness does not intentionally retain complete payment-card numbers, CVV/security codes, or similar payment credentials when those credentials are processed and stored directly by a payment processor. Payment processors may independently maintain information in accordance with their own privacy policies, security practices, and legal obligations.

D. Fitness, training, and wellness information

When voluntarily provided by a member or client, Atlas Fitness may collect information necessary to provide fitness, personal training, coaching, or wellness-related services:

• Fitness goals
• Training history
• Exercise preferences
• Workout information
• Fitness assessments
• Body measurements
• Body composition information, including InBody results
• Progress measurements
• Progress photographs
• Training notes
• Nutrition-related information voluntarily provided for coaching purposes
• Information concerning injuries, limitations, or physical conditions when voluntarily provided for the purpose of safely modifying training

Some of this information may be sensitive personal information under applicable law (see Section 13). Atlas Fitness is a fitness and training facility and does not provide medical diagnosis, medical treatment, or medical care.

E. Class and event participation

When you book, attend, or cancel a fitness class or event, we collect your registration and attendance records. We use this to track participant attendance and to manage space requirements.

4. Our mobile app

Our mobile app for iPhone and Android (“the App”) is provided for Atlas Fitness through our membership-software provider, Club Automation. This Privacy Policy applies to the App. When you use the App, we may collect:

• Name
• Email address
• Telephone number
• Membership information
• Account information
• Training information
• Workout information
• Fitness class or event participation
• Appointment information
• Messages
• Forms and submissions
• Progress information
• InBody or body-composition information, where integrated
• Application activity
• Device information
• IP address
• Authentication information
• Location information, only if you give permission (see Section 5)
• Other information necessary to operate the App

Atlas Fitness uses this information to provide and administer the applicable services.

Your controls in the App

• Location:you can allow, limit, or turn off location access at any time in your phone's settings.
• Push notifications:you can turn these off at any time in your phone's settings.
• Deleting your App account and data: see Section 18.
• Uninstalling the App stops further collection through the App.

5. Location data

The App collects location data only after you have granted permission.

This includes background location access to support a core feature that detects when you are near an Atlas Fitness facility location and enables a seamless check-in experience by prompting access to your access card barcode.

Location data is processed on your device to trigger relevant notifications. It is not stored by the App, not stored on our servers, and not shared with any third parties.

You can manage or disable location permissions at any time through your device settings.

6. InBody and body-composition data

Atlas Fitness may offer InBody or similar body-composition assessments. If you participate in an assessment, Atlas Fitness may collect and retain:

• Weight
• Body-fat percentage
• Skeletal muscle mass
• Body-water information
• Segmental measurements
• Circumference measurements
• Other measurements or calculations produced by the assessment device
• Assessment dates
• Historical assessment results

This information may be used to:

• Track fitness progress
• Assist with training decisions
• Provide coaching
• Compare changes over time
• Provide reports to members
• Improve training and member services
• Maintain client records

Body-composition information will not be intentionally disclosed publicly without appropriate authorization or another lawful basis. Because certain health-related information may be considered sensitive personal information under Connecticut law, Atlas Fitness will handle such information in accordance with applicable legal requirements (see Section 13).

7. Progress photographs

Atlas Fitness may offer or recommend progress photographs as part of personal training, coaching, or fitness programs. Progress photographs may be used to:

• Document a member's personal progress
• Compare changes over time
• Assist trainers with coaching
• Maintain training records
• Provide members with progress documentation

Progress photographs are treated as personal information.

Atlas Fitness will not intentionally publish or use an identifiable member's progress photograph for advertising, social media, promotional materials, testimonials, or other public-facing marketing without appropriate authorization when authorization is required.

A member may request that Atlas Fitness discontinue future promotional use of an image previously authorized for marketing, subject to applicable law and practical limitations concerning materials already published or distributed.

8. Personal training records

If you participate in personal training or coaching, Atlas Fitness and its authorized trainers may maintain records relating to your services, including:

• Training goals
• Workout programs
• Exercise history
• Session notes
• Attendance, sessions completed, and sessions remaining
• Progress measurements
• Body-composition assessments
• Progress photographs
• Trainer communications
• Appointment information
• Information voluntarily provided concerning physical limitations or training considerations

Personal training records are maintained for purposes including providing services, tracking progress, communicating with clients, maintaining accurate business records, and protecting the interests of Atlas Fitness and its clients.

Trainers and employees are expected to access member information only when reasonably necessary to perform their responsibilities.

9. Key fob, access control, and facility entry

Atlas Fitness operates access-control systems that may require members to use a key fob, access card, mobile credential, scanner, or other access mechanism. When you access the facility, Atlas Fitness may collect:

• Member identification
• Credential or key-fob information
• Date and time of entry
• Access point
• Successful or unsuccessful access attempts
• Other information generated by the access-control system

Access information may be used to:

• Provide 24-hour facility access
• Confirm membership eligibility
• Prevent unauthorized access
• Investigate security incidents
• Protect members and employees
• Investigate lost or stolen credentials
• Enforce membership policies
• Maintain facility security
• Maintain business records

10. Security cameras and video surveillance

For safety, security, loss prevention, incident investigation, and protection of members, employees, guests, and property, Atlas Fitness may operate video-surveillance cameras throughout portions of the facility. Security cameras may capture:

• Video images
• Date and time
• Location of activity
• Individuals present in monitored areas
• Facility activity

Cameras will not intentionally be placed in areas where individuals have a reasonable expectation of privacy, such as bathrooms or changing areas.

Security footage may be reviewed when reasonably necessary for:

• Safety investigations
• Theft investigations
• Property damage
• Member disputes
• Employee or trainer incidents
• Access-control issues
• Security investigations
• Insurance matters
• Law enforcement requests
• Legal proceedings
• Protection of Atlas Fitness and its members

Security footage may be disclosed to law enforcement, insurance companies, attorneys, or other authorized parties when reasonably necessary or legally required.

Security footage may be subject to technical limitations, system-specific retention periods, or automatic overwriting depending on the equipment and storage system used by Atlas Fitness.

11. Our website

Forms.If you fill out the “About You” questionnaire on our website, we collect what you enter: your name, phone number, email address (optional), what brings you in, your training experience, your main goal, what has gotten in the way, the best time to reach you, how you heard about us, and your consent to be contacted. The form is delivered to Atlas Fitness by email and stored in a Google Sheet. We use it to contact you about your goals and membership.

Join links.“Join” and pricing links on our website take you to our member portal, operated by Club Automation, where you sign up and pay.

Server logs. Our website is hosted by Vercel. Like any web host, Vercel automatically receives technical information when you visit, such as your IP address, browser type, the page requested, and the date and time, to deliver the site and keep it secure.

Cookies and tracking.Our website does not use advertising cookies, analytics cookies, or tracking pixels. Some pages show an embedded Google Map; when it loads, Google receives your IP address and may set its own cookies, under Google's privacy policy. If we add any analytics or tracking, we will update this policy first.

Do Not Track.Some browsers send a “Do Not Track” or Global Privacy Control signal. We do not track visitors across other websites or over time, so there is no tracking of ours for these signals to turn off.

Links to other sites. Our website links to other sites, such as Club Automation, Google Maps, and social media. Their privacy policies apply when you use them.

12. How Atlas Fitness uses personal information

Atlas Fitness may use personal information to:

1. Create and administer memberships.
2. Provide access to the facility.
3. Process payments and maintain account records.
4. Provide personal training and coaching.
5. Provide group classes and other fitness services.
6. Track attendance, class participation, and facility usage, and manage space requirements.
7. Perform InBody and other fitness assessments.
8. Track fitness progress.
9. Communicate with members.
10. Schedule appointments.
11. Provide customer support.
12. Send promotional communications (you can opt out; see Section 15).
13. Maintain facility security.
14. Investigate incidents.
15. Prevent fraud, abuse, and unauthorized access.
16. Maintain financial and business records.
17. Improve Atlas Fitness services.
18. Enforce membership agreements and other contracts.
19. Comply with applicable laws and legal obligations.
20. Protect the rights, property, safety, and security of Atlas Fitness, its members, employees, trainers, and other individuals.

Atlas Fitness does not sell personal information.

13. Sensitive personal information

Certain categories of information collected by Atlas Fitness may be considered sensitive personal information under applicable law. Depending on the circumstances, this may include:

• Certain health-related information
• Certain fitness or physical-condition information
• Body-composition information
• Certain biometric information
• Information concerning injuries or physical limitations
• Precise location information from the App (processed on your device only; see Section 5)

Atlas Fitness will use sensitive information only for legitimate business purposes connected with the services being provided and in accordance with applicable law.

Where the law requires your consent before we process sensitive information, we ask for it first.You can withdraw consent at any time by contacting us (Section 1). For App location, change your phone's location settings. Withdrawing consent stops future collection but does not undo processing already done, and some training services may not be possible without it.

14. Information sharing

Atlas Fitness does not sell personal information as part of its ordinary business operations.

We may share information with third parties when reasonably necessary to operate the business or provide requested services. These parties may include:

• Club Automation, our membership-management, member-portal, and mobile app provider
• Google and other cloud-service providers
• Vercel, our website host
• Payment processors
• Accounting and bookkeeping providers
• IT and technology providers
• Email and messaging providers
• Training and fitness software providers
• InBody or body-composition service providers
• Access-control system providers
• Insurance companies
• Attorneys and professional advisors
• Contractors and service providers
• Government agencies
• Law enforcement
• Courts or other legal authorities

Information may also be disclosed when reasonably necessary to:

• Comply with applicable law
• Respond to legal process
• Protect someone's safety
• Investigate fraud
• Investigate security incidents
• Protect Atlas Fitness's property or rights
• Enforce an agreement
• Respond to an emergency

Business transfer. If Atlas Fitness is sold, merged, or transfers its business or assets, member information may be transferred to the new owner as part of that transaction.

15. Member communications, text messages, and push notifications

Atlas Fitness may communicate with members by email, telephone, SMS/text messaging, push notifications, in-app messaging, postal mail, website notices, or other communication methods provided by the member.

Communications may concern memberships, billing, account status, facility announcements, schedule changes, training, classes, events, workshops, promotions, member benefits, customer service, and safety or security matters.

Operational communications may continue even when a member has opted out of promotional communications. Members may unsubscribe from promotional email or text communications where an opt-out mechanism is provided.

Text messages

If you agree to receive text messages from Atlas Fitness:

• Message frequency varies. Message and data rates may apply.
• Reply STOP to any message to stop receiving texts. Reply HELP for help, or call (860) 307-7744.

Push notifications

The App may send push notifications. You can turn them off in your phone settings at any time.

16. Google services and Atlas digital systems

Atlas Fitness may use Google Workspace and related Google services as part of its business operations. Depending on the systems implemented by Atlas Fitness, these may include Gmail, Google Drive, Google Forms, Google Sheets, Google Calendar, Google Sites, Google AppSheet, Google Meet, and other Google Workspace services or integrations.

Information submitted through an Atlas Fitness application, online form, digital portal, or other system may be transmitted to or stored within Google services.

For Google Workspace services, Google describes customer data as data submitted, stored, sent, or received through the services by the customer or its end users, and Google states that its processing of customer data is governed by the applicable Workspace agreement and data-processing terms. Atlas Fitness remains responsible for determining how it collects and uses information through its own systems. Google and other technology providers may process information on Atlas Fitness's behalf as service providers, processors, or under the applicable terms governing the particular service.

17. Data retention: how long we keep your information

Atlas Fitness's standard retention period is permanent. Unless applicable law requires otherwise, Atlas Fitness does not automatically delete member or customer information merely because:

• A membership is cancelled
• A membership expires
• A member stops attending
• A personal training relationship ends
• A member becomes inactive
• A customer stops using an Atlas Fitness service

Atlas Fitness may retain information indefinitely for legitimate business purposes, including membership history, contractual records, payment and transaction history, attendance history, access-control history, personal training records, fitness assessment records, InBody/body-composition records, member communications, customer-service records, incident records, insurance records, legal records, accounting and tax records, fraud-prevention records, security records, and business-history and recordkeeping purposes.

Exceptions

App location data

Not kept. Processed on your device only; not stored by the App or on any server.

Security camera footage

Subject to the recording system's retention limits and automatic overwriting, unless saved for an incident, claim, or legal request.

Information covered by a verified deletion request

Deleted as described in Section 18.

Important limitation. This permanent-retention policy does not eliminate or waive any privacy rights that an individual may have under applicable federal, Connecticut, or other applicable law, including the right to request deletion.

18. Deleting your data or your App account

You can ask Atlas Fitness to delete your personal information or your App account at any time. You do not need to have the App installed to make a request.

Please include your name, the phone number or email on your account, and whether you want your App account deleted, all of your information deleted, or specific information deleted.

Verification. Atlas Fitness may require reasonable authentication or verification before processing a request, to protect member information from unauthorized disclosure or deletion, usually by contacting you at the phone number or email already on your account.

What happens. After verifying your request, we will delete your App account and the personal information connected to it, except information we are allowed to keep for the reasons below. Where information has been provided to a service provider, such as Club Automation, Atlas Fitness will take reasonable steps consistent with its agreement with that provider and applicable law to address the request. We will respond within 45 days of receiving your request. If we need more time, we may extend this once by another 45 days and will tell you why.

What we may keep. Atlas Fitness may decline or limit deletion where applicable law permits or requires information to be retained, including information necessary to:

• Complete or document a financial transaction
• Comply with tax or accounting requirements
• Comply with legal obligations
• Establish, exercise, or defend legal claims
• Comply with legal holds
• Respond to litigation, subpoenas, or court orders
• Detect or prevent fraud
• Investigate security incidents
• Protect the safety, rights, or property of Atlas Fitness or another individual
• Enforce contracts
• Maintain records that cannot reasonably be separated from other records
• Meet insurance or regulatory requirements
• Fulfill other legally permitted purposes

If we keep information for one of these reasons, we will tell you what kind of information we kept and why.

19. Your privacy rights

To the extent applicable under Connecticut law, Connecticut residents may have rights concerning their personal data, including the right to:

• Access personal data, and confirm whether we process it
• Correct inaccurate personal data
• Delete personal data (see Section 18)
• Obtain personal data in a portable format
• Opt out of the sale of personal data, targeted advertising, and certain profiling
• Withdraw consent for processing sensitive data (see Section 13)
• Exercise other rights provided by applicable Connecticut law

These rights are subject to applicable legal requirements, exceptions, authentication requirements, and other limitations.

How to make a request. Use any method in Section 18. You may also use an authorized agent; we may ask the agent for proof of your permission and confirm your identity directly with you.

Response time. We will respond within 45 days, extendable once by 45 more days when reasonably necessary, with notice to you.

Appeals. If we deny your request in whole or in part, you may appeal by emailing atlasfitnessandhealthcenter@gmail.comwith the subject “Privacy Appeal.” We will respond in writing within 60 days and explain our reasons. If you are not satisfied with the result, you may contact the Connecticut Attorney General.

No discrimination. Atlas Fitness will not discriminate against an individual for exercising a privacy right where prohibited by applicable law.

20. Children

Our website and App are not directed to children under 13, and we do not knowingly collect personal information online from children under 13. If we learn that we have, we will delete it. A parent or guardian who believes their child under 13 has given us information can contact us using Section 1.

21. Data security

Atlas Fitness uses reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, destruction, or misuse. Security measures may include:

• Password protection
• Authentication
• Access controls
• Employee permissions
• Restricted access to sensitive records
• Secure cloud services
• Physical security
• Facility surveillance
• Administrative procedures
• Vendor security measures

No system for storing or transmitting information can be guaranteed to be completely secure. Accordingly, Atlas Fitness cannot guarantee absolute security of personal information.

22. Data breaches and security incidents

If Atlas Fitness becomes aware of a security incident involving personal information, Atlas Fitness will take reasonable steps to investigate, contain, and respond to the incident. Where required by applicable law, Atlas Fitness will provide notice to affected individuals and/or governmental authorities in the manner and timeframe required by law.

23. Third-party services

Atlas Fitness relies on third-party providers to operate portions of its business, such as Google, payment processors, membership software and the App (Club Automation), fitness applications, InBody or other assessment providers, email providers, SMS providers, website providers, scheduling systems, and access-control providers.

Third-party providers may maintain their own privacy policies and terms. When you use a third-party service directly (for example, a payment processor's checkout page or a social media site), that company's own privacy policy governs that service.

24. Legal disclosures

Atlas Fitness may disclose personal information when required or permitted by law, including in connection with:

• Subpoenas
• Court orders
• Government investigations
• Law enforcement requests
• Litigation
• Regulatory proceedings
• Insurance claims
• Fraud investigations
• Security investigations
• Emergency situations

Atlas Fitness may also disclose information when reasonably necessary to protect its legal rights, property, safety, members, employees, trainers, or other individuals.

25. Changes to this Privacy Policy

Atlas Fitness may modify this Privacy Policy from time to time to reflect changes in business operations, technology, applications, third-party providers, legal requirements, privacy practices, or member services.

The “Last Updated” date at the top of this Privacy Policy will indicate the most recent revision. When required by law, Atlas Fitness will provide additional notice regarding material changes.
